HB 297 - CERTIFICATE OF NEED PROGRAM                                                                                          
                                                                                                                                
CHAIRMAN DYSON  announced that the  first order of  business would                                                              
be HOUSE  BILL NO.  297, "An  Act relating  to the certificate  of                                                              
need program; and  providing for an effective date."   [HB 297 was                                                              
adopted     as    a    proposed     CS,    version     1-LS1301\G,                                                              
Chenoweth/Lauterbach, 2/8/00.]                                                                                                  
                                                                                                                                
CHAIRMAN  DYSON informed  members  that since  the committee  last                                                              
convened,  the  sponsor  of  HB  297,  Representative  James,  had                                                              
requested  that HB  297 go  to the  House  State Affairs  Standing                                                              
Committee.  Representative James  had heard the previous testimony                                                              
and  believes  the  bill  needs  a  significant  amount  of  work.                                                              
Therefore, this  committee will pass  out the bill, which  will go                                                              
to   the   House   State   Affairs   Standing   Committee   [which                                                              
Representative James  chairs].  When the bill  becomes acceptable,                                                              
the current committee will request  it back because if the bill is                                                              
significantly  altered, it  is more  appropriate  for the  current                                                              
committee  to deal  with the  new bill.   Chairman  Dyson said  he                                                              
hopes that process will take care of many of the concerns.                                                                      
                                                                                                                                
ELMER LINDSTROM,  Special Assistant,  Office of the  Commissioner,                                                              
Department of Health  & Social Services, came forward  to say that                                                              
he had  no objection,  and that there  was no  need to  pursue the                                                              
amendment which the department had proposed.                                                                                    
                                                                                                                                
REPRESENTATIVE GREEN made a motion  to move HB 297 from committee,                                                              
to the  House State  Affairs Standing  Committee, with  individual                                                              
recommendations.                                                                                                                
                                                                                                                                
REPRESENTATIVE BRICE objected to  say he wasn't sure if individual                                                              
recommendations were necessary because  the bill will come back to                                                              
the committee.                                                                                                                  
                                                                                                                                
REPRESENTATIVE GREEN pointed out that it wouldn't hurt to sign.                                                                 
                                                                                                                                
CHAIRMAN   DYSON  said   he  intends   to   sign  his   individual                                                              
recommendation and say "bring it back."                                                                                         
                                                                                                                                
REPRESENTATIVE BRICE withdrew his objection.                                                                                    
                                                                                                                                
CHAIRMAN  DYSON  indicated that  there  being no  objection,  CSHB
297(HES) was [moved out of the House  Health, Education and Social                                                              
Services Standing Committee and]  transmitted to the State Affairs
